Jacquees vs Ella Mai - How to Legally Make Cover Songs

In case you missed the buzz on Twitter last week. The internet exploded when Jacquees’ cover of “Trip” by Ella Mai was removed from Soundcloud and Youtube. While the internet decided it was a hater move on the part of Ella Mai, her label made it clear it was business related and she had no say in the matter.

A better description is that it was a LEGAL matter. As T-Pain pointed out you CANNOT monetize material that does not belong to you. In simple words that is THEFT in legal terms it is copyright infringement.

So how do artists cover other people’s songs all the time and how was THIS different?

I was mentioned by RollingStone.com after Times Up officially launched a campaign joining forces with the #MuteRKelly movement to demand industry action and consumer activism against the R&B singer who has yet to face repercussions despite decades worth of evidence and countless survivors including client Kitti Jones detailing the abuse, starvation, and sexual assault at the hands of Kelly. I am a proud member of Times Up and applaud their Women of Color working group for putting R Kelly at the top of their action list. 

Kelly's team responded to the campaign comparing the efforts to a public lynching of a black man of which Rollings Stone cover the opinion of myself, Ms. Jones, and others. Find out my thoughts and read the full article here:

Why the Remaining Freddie Gray Officers Don't Want to Face a Jury

In May Officer Edward Nero was acquitted of all charges and late last year Officer William Porter's case ended in a mistrial after a hung jury failed to make a decision.  What these cases tell us are two very clear facts.

First, the acquittal of Officer Nero, the bicycle cop who only assisted in the arrest of Gray, tells us that the evidence clearly shows Gray did not die as a result of injuries sustained in the actual arrest. 

Second, the hung jury in the case of Officer Porter shows that the evidence was NOT clear enough regarding what occurred in the actual transport of Gray that lead to his death.

So whether it was Porter's failure to adequately buckle Gray in the transport van as called for in the protocol or Goodson's failure to stop and get care when Gray is reported to have said "I can't breathe" in the back of the van it is unclear who is at fault.

So not only is HB2 blatantly discriminatory to the Transgender community but it also blatantly tears at the very fabric of American democracy. If the will of voters can be overturned at the whim of those at the highest levels of power then what purpose will local elections serve? If state legislatures provide no protections to those employed by the private enterprises that bring millions of dollars to their states then what incentive will businesses have to do right? What incentive will talent have to take jobs in states like North Carolina?
